1. Acceptance:

3. Account and security:

   1. You must keep your username and password confidential.

   2. You must inform us immediately if there is any unauthorized use of your account.

   3. You are entirely responsible for any activities that occur on your account.

   4. You are liable for any damage or costs that we or any third party sustain as a result of any actions taken using your account.

4. Technical Support Boundaries:

   1. HEXAServ does provide 24/7/365 Technical Support to all its customers.

   2. We don't offer any support to your customers, it is your duty to offer them needed support.

5. Refusal of Service:

   1. HEXAServ reserves the right at its sole discretion to refuse or cancel service.

   2. Violation of any of HEXAServ`s Rules and Regulations could result in a warning, suspension, or possible account termination. Accounts terminated due to policy violations will not be refunded.

6. Disclaimer:

   1. HEXAServ will not be responsible for any damages affects your business you cause.

   2. Failure to follow any terms and conditions may result in account deactivation.

7. Limitation of Liability:

   HEXAServ is not responsible for any claimed damages, including incidental or consequential damages, resulting from any corruption or deletion of any web site from one of our servers. All complaints will be investigated promptly.

8. Money Back Guarantee:

   1. We offer 30 days money back guarantee in case you are facing any troubles with the service we offer you and not satisfied with the quality of the service you receive. Refund is done in this case and you receive your money but after reducing the processing fees which can be determined according to the location of the customer and the method of refund.

   2. No Refund will be issued for accounts that are terminated by HEXAServ due to policy violations.

9. Customer Abuse:

   Any customer deemed at our sole discretion to be abusive to our company and/or service we provide and/or our employees will result in immediate account termination without any refund. Any negative feedback on any public forum about our company without prior discussion with our staff about your problem may result in your account termination.

10. Non-Payment:

    Payment for services must be received no later than 7 days after the first day of the renewal cycle. If payment is not received within this period, services may be suspended. If delayed after this grace period, termination will occur and you will lose any data.

11. Suspension and termination:

    We may suspend and/or terminate some of our services or licences to you. Causes may include but not limited to:

    1. Scheduled downtime to permit us to conduct maintenance.

    2. Emergency system repair or a system security breach.

    3. Required to do so by law.

    4. if we are unable to deliver services to you due to circumstances beyond our control.

    5. if you use the services in contravention of these terms, applicable law, regulation.

    6. If you fail to pay any fees due to us.

12. API:

    1. You shall have a valid and active account that has not been terminated or suspended pursuant to the terms of service.

    2. You agree to use the API only for purposes that are legal, proper and in compliance with the terms of service, and any other applicable policies or guidelines. If you are an international user, you shall comply with your own local rules regarding online conduct and acceptable content.

    3. You agree that you are responsible for API calls processed using your account and for any consequences thereof.

    4. You shall not use the API to develop a client that constitutes, promotes, or is used in connection with spyware, adware, other malicious programs or code.

    5. You shall not use the API in any manner or for any purpose that violates any law or regulation, any right of any person.

    6. You shall not use the API in a manner that adversely impacts, or disrupts our systems.

13. Service related terms:
    1. SMS:

       1. SMS messages may flow through several mobile networks to reach recipient’s mobile handset. Message is considered to be delivered once it has been delivered to our next network service provider.

       2. Regarding SMS IN, message is considered to be delivered when it is received by our system and submitted to your account.

       3. We offer you delivery reports for all sent messages. However, this would be only available if the operator returns us the current status of the message.

    2. Domain names:

       1. Domain names registered under your account is completely owned by you, HEXAServ doesn't own such domain names.

       2. Domain names using Whois Privacy Protection Service is owned by their original account holder and not owned by HEXAServ.

       3. You agree to provide correct Whois Information for your domain name. Inaccurate Whois Information may lead to domain name cancellation.

       4. Any service including domain name registration, in case of refund, the domain name price will be reduced from the refund amount.

    3. Hosting:
       1. Contents:

          1. All services may be used for lawful purposes only. You must not submit, publish, or display on the network any defamatory, inaccurate, abusive, obscene, infringing, or threatening content. In addition, you may not submit, publish, or display any content that violates law.

          2. You are solely responsible for the content you make accessible on the network.

          3. HEXAServ has the right, but not obligated, to edit, remove or deny access to such content.

          4. HEXAServ may disclose any content or records concerning customer's account as required to satisfy any law, regulation, governmental request or court order.

          5. Sites that promote any illegal activity or content that may be damaging to HEXAServ network or servers will be terminated without any refund.

          6. Illegal contents include, but not limited to:

             • Pirated Software
             • Copyright Violations
             • Hackers programs or archives
             • Pornography
       2. DMCA:

          1. The DMCA (Digital Millennium Copyright Act) was passed by the U.S. Congress in 1998 to deal with copyright infringement by electronic means.

          2. We will remove or at least block access to content upon receipt of a proper notice of copyright infringement. Repeated violations of copyright laws may result in account termination.

       3. Bandwidth:

          1. Customer agrees that advertised bandwidth allowances represent the sum of the incoming and outgoing allowances per account per calendar month.

          2. If advertised bandwidth is not enough for your site, your account may need to be upgraded.

       4. Chat Rooms:

          HEXAServ allows its customers to install their chat scripts as long as it doesn't affect server performance.

       5. Background Running Programs:

          1. HEXAServ allows background daemons as long as server performance is not affected.

          2. Extra charge may be added based on system resources used.

       6. Cron Jobs:

          HEXAServ allows cron jobs on its servers.

       7. IRC:

          HEXAServ currently prohibits its customers from operating IRC or IRC Bots on any of the servers.

       8. Server Resources:

          Any web site that uses a high usage of server resources (such as, but not limited to CPU, memory usage, and network resources) will be given an option of either upgrading their account or reducing the resource cause this load.

       9. Multiple Connections:

          Multiple ftp sessions are allowed, on a single hosting account.

       10. Free Hosting:

           Each account can have only one free host. Opening multiple accounts to host more than one free host may lead to account suspension or termination.

14. Commercial Advertising/Mass Mailings/SPAM:

    1. Sending of unsolicited email or SMS messages using our network is STRICTLY prohibited. The account sending spam may be suspended or terminated without refund.

    2. We reserve the right to refuse or cancel service to known spammers.

15. Use of our logo:

    1. You can use our logo/name in your site however it MUST NOT be used in a way that misleads internet users into believing that a web page, or a web site is owned by or affiliated with HEXAServ.

    2. You are not allowed to make any modifications to the logo/name of HEXAServ.

16. Modifications:

    1. HEXAServ retains the right to change any or all of the above Policies, Guidelines, and Disclaimers without notification.

    2. If we change our terms of service, we will post the changes on this page, and may place notices on other pages of the website.
